International action in combating insider trading
Bern, 03.12.2025 — On Tuesday, 2 December 2025, a number of interventions on suspicion of insider trading took place in Switzerland, Germany and the United Kingdom as part of several criminal proceedings conducted by the Office of the Attorney General of Switzerland (OAG). The criminal proceedings are being conducted against five individuals who are alleged to have exploited confidential and price-sensitive information relating to a listed international Swiss company.
Simultaneous searches were carried out in the three countries at the private residences of the accused individuals and at several company locations. All five accused individuals are suspected of having held senior positions at the specific company, during the relevant period, in 2024 or earlier. The company operates in the IT sector, with its head office located in Switzerland, and is listed on the Swiss stock exchange. The OAG’s criminal proceedings are not directed against the company itself.
Subject of the criminal proceedings
In 2024, the company published two pre-market press releases that had a negative impact on its share price. Prior to the publication of the press releases, the five accused individuals each sold large quantities of the company’s shares. The OAG suspects that the accused individuals exploited the confidential information (insider trading) contained in the media releases to sell the shares at the right time, thereby allegedly avoiding financial losses of up to CHF 2.49 million. The presumption of innocence applies to all the accused individuals.
In Switzerland interventions took place in cooperation with the Federal Office of Police fedpol. The interventions in Germany and the United Kingdom were carried out based on international requests for mutual legal assistance made by the OAG to the relevant authorities. The interventions were coordinated by Eurojust (the European Union Agency for Criminal Justice Cooperation). The OAG extends its gratitude to all participating partner authorities for the seamless preparation and execution of the interventions, as well as Eurojust for its support and coordination.
